Terms of Service

Forget The Gym is operated by Dave Vaughan, a certified personal trainer based in Las Vegas, Nevada. Contact: dave@mytrainerdave.com or (702) 743-2972.

Exercise carries risk. Nothing here is medical advice, and Dave is not your doctor. Talk to a physician before starting any training program, especially if you're pregnant, have a heart condition, an injury, or any diagnosed condition.

You are responsible for stopping when something hurts and telling Dave about injuries, medications and limitations. Training is undertaken at your own risk, and in-person clients sign a separate waiver before their first session.

Private 1-on-1 training is currently available in the Las Vegas area, including Henderson and Summerlin. Sessions take place in your home, a private studio, a hotel or residence gym, or an approved on-site location.

Session terms, pricing, packages and cancellation windows are set out in your individual training agreement, which takes priority over this page if they ever disagree. As a general rule, sessions cancelled with less than 24 hours' notice may be charged.

The Play By Dave app membership is billed monthly. The price, any free period and the renewal date are shown at checkout before you pay. Memberships renew automatically until you cancel, and you can cancel any time from your account — access continues until the end of the period you've paid for.

One-time purchases and add-ons are charged once. Where an item includes work Dave personally does for you, the stated turnaround is a target, not a guarantee.

Payments are processed by our payment provider. We don't store your full card details.

If something isn't right, email dave@mytrainerdave.com and say what happened. Refunds on digital products and memberships are handled case by case, in good faith. In-person training refunds follow your training agreement.

Some supplement recommendations link to third-party retailers, and Dave may earn a commission if you buy through them, at no added cost to you. That's disclosed beside every such link. Recommendations are opinions based on coaching experience, not clinical advice, and no result is guaranteed.

Keep your login to yourself and tell us if you think someone else has it. Don't scrape, resell, reverse engineer or abuse the service, and don't upload anything unlawful or anything you don't have the right to share.

We may suspend an account that's being used to harm other people or the service.

Photos, videos, check-ins and messages you send stay yours. We use them only to coach you. Nothing identifying you is published as a testimonial or before-and-after without your explicit written permission.

Applying or signing up means we can email you about your enquiry and account. Marketing emails always have an unsubscribe link. Text messages only go to people who ticked the consent box — reply STOP to opt out, HELP for help. Message and data rates may apply.

To the fullest extent the law allows, Forget The Gym's total liability arising from these services is limited to the amount you paid in the twelve months before the claim. We're not liable for indirect or consequential losses. Nothing here limits liability that can't legally be limited.

These terms may change; the date at the top tells you when they last did. Material changes to billing are communicated by email first. These terms are governed by the laws of the State of Nevada.
